Kestrel Coal Enterprise Agreement
On behalf of the miners, cfMEU had argued that his dismissals were not genuine layoffs, as their work still had to be carried out, and it would have been reasonable to redeploy them to an associate unit of Kestrel, Rio Tinto Coal Australia Pty Limited (RTCA), of which Kestrel is a subsidiary, or within the Rio Tinto Ltd (Rio Tinto) group. In addition to Kestrel, RTCA had three other subsidiaries operating coal mines. Rio Tinto has also had other related companies outside the rtca group (RTCA group). Kestrel stated, however, that the jobs were redundant and that it had considered all redeployment options within Kestrel and the RTCA group prior to the dismissal of the miners. Kestrel also argued that it did not interfere with the power to govern to redeploy miners to Rio Tinto Group facilities. In light of all the above findings, Commissioner Spencer concluded that Kestrel had found that the layoffs were genuine layoffs. Boyd is a sales and marketing manager with nearly two decades of experience in the coal industry. Boyd received his engineering degree from the University of Queensland and his Master of Finance from the Financial Services Institute of Australia. Prior to his last role in Rio Tinto as head of the coal distribution and marketing team, Boyd held a number of positions at Rio Tinto, including marketing director for Rio Tinto`s coking coal portfolio in Australia and Mozambique. Boyd previously worked in operational and technical positions in the Queensland and NSW coal mines for Rio Tinto, Anglo American and BHP. Jess Roberson was appointed director of the group People at Kestrel in August 2018. Jess played an important role in the transition from Rio Tinto`s Kestrel mine to Kestrel Coal Resources. Jess is an experienced HR manager with more than 15 years of coal. She has worked for a number of commodities companies, including Rio Tinto, Glencore and BHP. Prior to Kestrel, Jess was in Human Resources at Glencore Clermont Coal, where she played a crucial role in the sale of Rio Tinto`s mine to Glencore. She has also been part of successful negotiating teams for a series of new business agreements. Jess has a wide range of HR experiences in down and labour relations.
